1. Acceptance of Terms

By accessing or using the services provided by Forever Nails Spa (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of any modifications.

2. Services Description

Forever Nails Spa provides nail care and related beauty services, including but not limited to:

• Manicures and pedicures
• Nail enhancements (gel, acrylic, dip powder)
• Nail art and design
• Related beauty treatments

3. Appointments & Scheduling

Booking: Appointments may be made online, by phone, or in person. By booking an appointment, you agree to arrive on time and honor your reservation.

Cancellation Policy:

• We request at least 24 hours notice for cancellations
• Late cancellations or no-shows may be subject to a cancellation fee
• Repeated no-shows may result in required deposits for future appointments

Late Arrivals:

• If you arrive late, your service time may be shortened to accommodate other appointments
• Arrivals more than 15 minutes late may need to be rescheduled

Walk-ins: Walk-in clients are welcome based on availability. We cannot guarantee immediate service for walk-ins during busy periods.

4. Payment Terms

Payment Methods: We accept cash, credit cards, debit cards, and other payment methods as posted.

Pricing:

• Prices are subject to change without notice
• Quoted prices are estimates; final prices may vary based on service complexity
• Additional charges may apply for nail repairs, extended lengths, or special requests

Gratuities: Tips are appreciated and go directly to your service provider. Gratuities are not included in service prices.

Refunds: Due to the nature of our services, refunds are generally not provided. If you are unsatisfied with your service, please speak with management immediately so we can address your concerns.

5. Health & Safety

Sanitation: We maintain strict sanitation standards in compliance with state health regulations. All tools are properly sanitized between clients.

Health Conditions: Please inform your service provider of any:

• Allergies or sensitivities to products
• Skin conditions or infections
• Diabetes or circulation issues
• Pregnancy
• Any other relevant health conditions

Service Refusal: We reserve the right to refuse service if we observe signs of:

• Fungal or bacterial infections
• Open wounds or cuts
• Contagious skin conditions

This is for the protection of both our clients and service providers.

6. Limitation of Liability

To the fullest extent permitted by law, Forever Nails Spa and its independent contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Service Results:

• Results may vary based on individual nail conditions
• We do not guarantee specific outcomes or longevity of services
• Nail enhancements require proper care and maintenance

Allergic Reactions: While rare, allergic reactions to products may occur. By using our services, you acknowledge this risk and agree to inform us of any known allergies.

Personal Belongings: We are not responsible for lost, stolen, or damaged personal items.

7. Service Waiver & Acknowledgment

By receiving services at Forever Nails Spa, you acknowledge and agree that:

• You have disclosed all relevant health conditions
• You understand the risks associated with nail services
• You release Forever Nails Spa and its service providers from liability for reactions or outcomes beyond our reasonable control
• You will follow aftercare instructions provided by your service provider

You may be asked to sign a service waiver at check-in for certain services.

8. Client Conduct

We strive to maintain a welcoming environment for all clients. We expect all clients to:

• Treat staff and other clients with respect
• Refrain from using offensive language or behavior
• Follow salon policies and staff instructions
• Supervise children at all times

We reserve the right to refuse or terminate service to anyone who violates these standards or creates an uncomfortable environment for others.

9. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Forever Nails Spa and is protected by copyright and trademark laws.

Photography:

• With your consent, we may photograph your completed services for our portfolio
• Photos may be used on our website and social media
• You may opt out of photography at any time

10. Independent Contractor Relationship

Service providers at Forever Nails Spa operate as independent contractors under booth rental arrangements. This means:

• Each contractor is an independent business owner
• Contractors set their own schedules and service offerings
• Contractors are responsible for their own licensing and insurance
• Forever Nails Spa provides the facility and coordination services

When you book with a specific contractor, you are engaging their independent services within our facility.

11. Communications & SMS Terms

By providing your contact information, you consent to receive:

• Appointment confirmations and reminders
• Service updates and important notices
• Promotional communications by email only (with your explicit consent); text messages are limited to appointment-related messages

12. Dispute Resolution

Concerns: If you have any concerns about your service, please bring them to our attention immediately. We are committed to addressing issues promptly and fairly.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas.

Resolution Process:

• We encourage direct communication to resolve any issues
• Disputes should first be addressed with management
• Unresolved disputes may be subject to mediation

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
